The National Science and Technology Council (hereinafter the Council) is established by the Executive Yuan for the purpose of planning, coordinating, reviewing matters, and allocating resources for national scientific development and technological research and application.
1The Council shall be in charge of the following matters:
21. Overall planning, coordination, review of national policies on scientific development, technological research and application, and allocation of resources.
32. Overall planning, coordination, review of national scientific development, technological research and application programs, and resource allocation and management assessment.
43. Promotion of basic and applied scientific and technological research.
54. Promotion of major science and technology R&D programs and support for academic research.
65. Overall planning, coordination, and promotion of forward-looking industrial technology R&D and university-institute innovation policies.
76. Planning and promotion of science park development.
87. Management of the Executive Yuan National Science and Technology Fund.
98. Other matters concerning scientific development, technological research and applications.
1The Council shall have one minister, who shall concurrently be a Minister without Portfolio of the Executive Yuan; and three deputy ministers, of whom two shall be equivalent to 14th-grade senior-level civil servants and the other shall be a 14th-grade senior-level civil servant.
2The Council shall have between eleven and fifteen Council members, all assigned or appointed from heads of research institutions, heads of relevant central government agencies and academics and experts on a concurrent basis by the Premier of the Executive Yuan.
The Council shall have one Secretary-General, who shall be a 12th-grade senior-level civil servant.
1The Council's subordinate agencies and their duties shall be as follows:
21. Hsinchu Science Park Administration: Implementation of matters prescribed in the Act for Establishment and Administration of Science Parks.
32. Central Taiwan Science Park Administration: Implementation of matters prescribed in the Act for Establishment and Administration of Science Parks.
43. Southern Taiwan Science Park Administration: Implementation of matters prescribed in the Act for Establishment and Administration of Science Parks.
1To meet service needs, the Council may, upon obtaining the consent of the Executive Yuan, send personnel to work abroad, and shall handle relevant matters in accordance with the Organization Act of Diplomatic Missions.
2When necessary, individuals at junior college or higher-level schools who are qualified professors may be appointed to join the personnel assigned to work at a diplomatic mission overseas referred to in the preceding paragraph and serve as the head of the science and technology division of an overseas agency. The period of appointment of such individuals may not exceed four years, and they shall return to their original post at the end of this period.
When necessary, an individual possessing the equivalent of professorial qualifications at a school at the level of junior college or above may be hired to serve as the head of the Council's first-level service units; the retirement and consolation payments of such individuals shall be handled in accordance with regulations concerning teachers, and the Council shall grant its approval to such arrangements.
In view of the rapid development of science and technology worldwide, and the need to diversify the recruitment of scientific and technological talents in order to enhance Taiwan's scientific and technological competitiveness, the Council may, pursuant to the Contract-based Worker Employment Act, hire professional scientific and technical personnel in such areas as the natural sciences, engineering technology, life sciences, humanities and social sciences, development of science education, international cooperation in science and technology, sustainable development research, industry-academic R&D and applied science and technology, and scientific and technological policy and management; the number of such hired personnel may not exceed 110 persons.
The rank and grade of various positions at the Council, and the number of personnel, shall be set on the basis of the organizational chart.
The promulgation date of this Act shall be set by order of the Executive Yuan.
