Fee-charging Standards for Reviewing Applications of the Establishment of Tourist Amusement Enterprises by the Tourism Administration, Ministry of Transportation and Communications

This Standard is promulgated in accordance with Article 10 (1) of Charges And Fees Act.
The Tourism Administration of the MOTC (hereinafter referred to as "the Administration") shall charge NT$200,000 per application review fees for processing applications for the establishment of tourist amusement enterprises.
1For applicants who have received an establishment permit for a tourist amusement enterprise and apply for changes to the business plan, the following review fees shall apply:
21.NT$150,000 per application for expanding proposed area or changes in use of overall area;
32.For other purposes, a NT$50,000 application fee will be charged.
4If a change is requested for governmental reasons, the fee may be waived.
1The Administration, upon processing an application for establishing a tourist amusement enterprise or for changes to its original business plan, shall notify the applicant in writing to pay the review fee within a prescribed period of time after all required documents have been submitted and confirmed to be accurate. Default of payment shall result in denial of review and may lead to return of the application package.
2Applicants who fail to pay the review fee within the prescribed period of time due to natural disasters, accidents, or other force majeure reasons may apply, within 10 days of the end of the causative issue, to the Administration for an extension of the payment deadline. This extension may be up to one year in length. The applicant should provide an explanation for the request, as well as relevant documentation.
Applicants may pay the review fee in cash, demand note or check issued by a financial institution, or postal money order.
Applicants may not request a return of the relevant review fee once it has been paid, but may apply for the return of an excessive or erroneous payment in accordance with Article 18 of Charges And Fees Act.
The Administration shall review these fees at least once every three years, with consideration to changes in processing costs as well as overall cost levels. The Administration will report the results of these reviews to the MOTC, including a discussion of any recommended changes to fee levels.
This Standard shall become effective on the date of its promulgation.
