醫師法施行細則

The following enforcement rules have been formulated in accordance with Article 42 of the Physicians Act (hereinafter, “the Act”).

1Departments/divisions of medicine, Chinese medicine, and dentistry at foreign universities or independent colleges complying with the Ministry of Education recognition rules (collectively, “medical programs”), as described in Articles 2 through 4 of the Act, shall refer to foreign academic institutions with medical programs that are equivalent to domestic medical programs at the same educational level in terms of admissions eligibility, graduation institutions, prescribed period of study, curriculum, and official recognition by local government’s educational authority or a professional accreditation entity endorsed by the authority in accordance with Article 12 of the Regulations Governing the Assessment and Recognition of Foreign Academic Records by Institutions of Higher Education and in reference to Articles 4 and 9 of the same Regulations.

2The principles and methods for recognizing foreign medical programs, as described in the preceding paragraph, including the determination of their equivalence to domestic programs of the same educational level and the conditions for non-recognition, shall be governed by Articles 10 through 13 herein.

3The provisions of the preceding paragraph shall apply to students who commenced their studies in a foreign medical program on or after January 1, 2017.

1Completion of internship with a passing grade, as stipulated in Articles 2 through 4 of the Act, refers to the fulfillment of the required number of weeks or hours of clinical training as prescribed in Articles 4 through 6 herein under the supervision of a physician, as well as obtaining a passing grade in each required subject at a medical institution that has been certified by a teaching hospital accreditation body to offer clinical training, with proof issued by the medical institution. Individuals falling under any of the following situations shall be required to take a clinical skills examination conducted at a teaching hospital accredited by a professional institution, legal entity, or organization commissioned by the central competent authority:

21. Students pursuing a double major in medicine and Chinese medicine whose graduation date falls on or after August 1, 2012

32. Graduates of foreign medical program who have been matched with and assigned to a medical institution for clinical training and whose completion date falls on or after January 1, 2013

4The evaluation of the clinical practice adaptability training referred to in Article 4–1, Paragraph 2 of the Act shall include the clinical skills examination mentioned in the preceding paragraph.

1The required subjects and corresponding number of weeks or hours of the internship, as prescribed in Article 2 of the Act, are as follows:

21.Internal Medicine: Not less than 12 weeks or 480 hours

32.Surgery: Not less than 12 weeks or 480 hours

43.Obstetrics and Gynecology: Not less than 4 weeks or 160 hours

54.Pediatrics: Not less than 4 weeks or 160 hours

65.At least three other elective subjects: Not less than 2 weeks or 80 hours for each subject

7The total number of weeks or hours for the subjects listed in the preceding paragraph shall not be less than 48 weeks or 1,920 hours.

1The required subjects and corresponding number of weeks or hours of the internship, as prescribed in Article 3 of the Act, are as follows:

21.Chinese Internal Medicine: Not less than 18 weeks or 720 hours

32.Chinese Traumatology: Not less than 8 weeks or 320 hours

43.Acupuncture: Not less than 9 weeks or 360 hours

54.Chinese Gynecology and Pediatrics: Not less than 9 weeks or 360 hours

6The total number of weeks or hours for the subjects listed in the preceding paragraph shall not be less than 45 weeks or 1,800 hours.

1The required subjects and corresponding number of weeks or hours of the internship, as prescribed in Article 4 of the Act, are as follows:

21.Pediatric Dentistry: Not less than 2 weeks or 80 hours

32.Oral and Maxillofacial Surgery: Not less than 8 weeks or 320 hours

43.Orthodontics: Not less than 2 weeks or 80 hours

54.Prosthodontics: Not less than 18 weeks or 720 hours

65.Periodontics: Not less than 4 weeks or 160 hours

76.Endodontics: Not less than 4 weeks or 160 hours

87.Operative Dentistry: Not less than 2 weeks or 80 hours

98.At least three other elective subjects: Not less than 18 weeks or 720 hours in total

10The required clinical training hours set forth in the preceding three articles shall not include nighttime or holiday on-call shifts.

The required clinical training hours set forth in the preceding three articles shall exclude nighttime or holiday on-call shifts.

1Holders of a foreign physician license who have served as full-time faculty members in international medical programs or as attending physicians at hospitals designated by the medical programs after graduating from a foreign university or independent college may apply to the central competent authority for a reduction in the required clinical training weeks or hours set forth in Articles 4 through 6 herein for the medical field indicated on their foreign physician license. However, the reduction in weeks or hours shall not exceed two thirds of the total required duration for the subject.

2Review for applications submitted under the preceding paragraph shall be performed by a panel appointed by the central competent authority, consisting of physicians, medical professionals, medical scholars, and government representatives, of which no less than one half shall be physicians, medical professionals, and medical scholars.

To qualify under Article 4–1, Paragraph 1, Subparagraph 2 of the Act — regarding admission to medical programs in certain countries or jurisdictions prior to December 31, 2022— candidates must have been formally enrolled and commenced their studies in such a program by December 31, 2022.

1The criteria for determining the equivalence of foreign medical programs to domestic programs at the same educational level, in terms of admissions eligibility, graduation institutions, prescribed period of study, and curriculum, as set forth in Article 2, shall be as follows:

21.Postbaccalaureate medicine programs:

3(1) Admissions eligibility: Possession of a baccalaureate or bachelor’s degree

4(2) Graduation institutions: Institutions included on the Ministry of Education’s Reference List or officially recognized by the local government’s educational authority or a professional accreditation entity endorsed by the authority

5(3) Prescribed period of study: Not less than four years

6(4) Curriculum: Comparable to the core competencies and core curriculum offered by domestic postbaccalaureate medicine programs

71.Courses: Preclinical medicine and Clinical medicine (See Appendix I).

82.Earning at least 167 credits or completing at least 5,250 hours of courses at the time of graduation, including no less than 3,200 hours of clinical internship

1The criteria for determining the equivalence of foreign Chinese medical programs to domestic programs at the same educational level, in terms of admissions eligibility, graduation institutions, prescribed period of study, and curriculum, as set forth in Article 2, shall be as follows:

21.Postbaccalaureate Chinese medicine programs:

3(1) Admissions eligibility: Possession of a baccalaureate or bachelor’s degree

4(2) Graduation institutions: Institutions included on the Ministry of Education’s Reference List or officially recognized by the local government’s educational authority or a professional accreditation entity endorsed by the authority

5(3) Prescribed period of study: Not less than five years

6(4) Curriculum: Comparable to the core competencies and core curriculum offered by domestic postbaccalaureate Chinese medicine programs

71.Courses: Preclinical medicine, Preclinical Chinese medicine, Clinical medicine, and Clinical Chinese medicine (See Appendix II).

82.Earning at least 204 credits or completing at least 5,404 hours of courses at the time of graduation, including no less than 1,120 hours of clinical observation/internship and 1,800 hours of clinical internship in Chinese medicine

1The criteria for determining the equivalence of foreign dentistry programs to domestic programs at the same educational level, in terms of admissions eligibility, graduation institutions, prescribed period of study, and curriculum, as set forth in Article 2, shall be as follows:

21.Postbaccalaureate dentistry programs:

3(1) Admissions eligibility: Possession of a baccalaureate or bachelor’s degree

4(2) Graduation institutions: Institutions included on the Ministry of Education’s Reference List or officially recognized by the local government’s educational authority or a professional accreditation entity endorsed by the authority

5(3) Prescribed period of study: Not less than four years

6(4) Curriculum: Comparable to the core competencies and core curriculum offered by domestic postbaccalaureate dentistry programs

71.Courses: Preclinical medicine, Preclinical Dentistry, and Clinical Dentistry (See Appendix III).

82.Earning at least 204 credits or completing at least 5,300 hours of courses at the time of graduation, including no less than 650 hours of clinical simulation (including Dental Morphology Lab, Operative Dentistry Lab, Periodontics Lab, Endodontics Lab, Fixed and Removable Denture Lab, Pediatric Dentistry Lab, Orthodontics Lab, Oral Surgery, and Anesthesiology Lab) and 2,014 hours of clinical observation/internship

1Foreign academic records falling under any of the following subparagraphs shall not be recognized:

21. Degrees obtained through correspondence education

32. Degrees obtained through remote learning, except for partial credits obtained during an outbreak of communicable diseases (as described under Article 3, Paragraph 1 of the Communicable Disease Control Act), a disaster (as described under Article 2, Paragraph 1 of the Disaster Prevention and Protection Act), or other force majeure events

43. Certificates (proof) obtained from a continuing education program

54. Doctoral degrees obtained by merit of writing a dissertation without being formally enrolled and actually taking courses

65. Honorary degrees

76. Degrees obtained by merit of taking courses taught in Chinese in a country where Chinese is not an official or commonly used language

87. Degrees obtained by taking courses at a domestic branch, campus, or degree program established by a foreign institution without Ministry of Education approval

1Europe, as described in Article 4–1 of the Act, refers to the member states of the European Union and the United Kingdom.

2Individuals seeking to take licensure examinations with a foreign degree from a country or jurisdiction listed in Article 4–1, Subparagraph 1 of the Act must have completed the entire medical program in an eligible country or jurisdiction. Credits transferred from other countries or jurisdictions shall not be recognized.

1To request a physician, doctor of Chinese medicine, or dentist license under Article 7 of the Act, applicants shall fill out the designated application form, attach the corresponding examination passing certificate issued by the Examination Yuan, and submit the application along with the prescribed license issuance fee to the central competent authority for approval.

2The application and approval process referred to in the preceding paragraph may be conducted electronically through a system established by the central competent authority.

1In the event of a lost or damaged physician, doctor of Chinese medicine, or dentist license, the applicant shall fill out the designated application form, pay the prescribed reissuance fee, and, in the case of a damaged license, submit the original license to the central competent authority for reissuance or replacement.

2The application process referred to in the preceding paragraph may be conducted electronically through a system established by the central competent authority.

Pursuant to Article 8–2 of the Act, each physician may register only one institution as their place of practice.

1The term “special reason” as stated in the proviso of Article 8, Paragraph 2 of the Act shall refer to any of the following circumstances that may affect a physician’s ability to fulfill continuing education requirements:

21.Serious illness

32.Childbirth, parental leave, and pregnancy-related medical leave

43.Continuing education in a foreign country

54.Directives, restrictions, and other measures imposed by the commander-in-chief of the Central Epidemic Command Center

65.Other causes imposed by the central competent authority

1To report the discontinuation or suspension of practice in accordance with Article 10, Paragraph 1 of the Act, physicians shall fill out the designated application form, attach their practice license and relevant supporting documents, and submit them to the original issuing authority for processing:

21.Discontinuation: Practice registration and practice license shall be revoked

32.Suspension: Practice license shall be returned following recording of the period of and reasons for suspension

The term “concerned authorities” in Article 22 of the Act shall include health, law enforcement, and police authorities.

Candidacy for directors and supervisors of the Taiwan Medical Association shall not be limited to members appointed by local medical associations of each administrative region.

Representatives appointed to the Taiwan Medical Association by local medical associations of each administrative region shall not be limited to the directors and supervisors of those local associations.

1The number of representatives appointed to the Taiwan Medical Association by local medical associations of each administrative region shall be proportionate to the number of Taiwan Medical Association members in each administrative region.

2If the resulting quota is less than one for any local association, the quota shall be rounded up to one.

3The representative quotas, as provided in the preceding paragraph, shall be stipulated in the charter of the Taiwan Medical Association.

The format for physician licenses, practice licenses, and application forms shall be prescribed by the central competent authority.

These rules shall be implemented on the date of promulgation.
