Regulations on Satellite Broadcasting Program Supplier Broadcasting Domestically-Produced Programs

These Regulations are formulated pursuant to Paragraph 4, Article 8 of Satellite Broadcasting Act (hereinafter referred to as the Act).
While undertaking program planning, satellite broadcasting program supplier businesses (referred to hereinafter as "program supplier") shall consider content diversity, protect human dignity, fulfill social responsibilities, and safeguard national culture.
In order to safeguard national culture, the programs broadcasted by program suppliers shall conform to the ratio of domestically-produced (Republic of China) programs stipulated by the competent authority.
1The domestically-produced programs mentioned in the preceding article refer to the programs produced by domestic producers and shall be identified according to the standards in the following order:
21.The country of such program shall be identified based on the main actors (leading actor and supporting actor) of the same nationality exceeding one third of the total number of main actors, or the producer, director and screenwriter of the same nationality or region exceeding one third of the total number of aforesaid positions.
32.The original country of such program shall be identified based on the highest number of main actors (leading actor and supporting actor) of the same nationality.
43.The original country of such program shall be identified based on the total highest number of producers, director, screenwriters and main actors (leading actor and supporting actor) being of the same nationality.
54.The original country of such program shall be identified based on the total highest number of producers and director being of the same nationality.
65.The original country of such program shall be identified based on the original country of the business people, juridical persons, organization or other institution of program production.
76.The original country or region of such program shall be identified based on the original nationality of the investor with the largest capital contribution.
1If an individual channel operated by a program supplier broadcasts the following types of programs during the designated broadcasting times, the percentage of domestically-produced programs shall not be lower than twenty-five percent; the percentage of new broadcasts thereof shall not be lower than forty percent. For the broadcast of movies (including documentaries) during designated time slots, the percentage of domestically-produced programs shall not be lower than twenty-five percent; the ratio of new broadcasts thereof shall not be lower than twenty percent.
21. Dramas;
32. Movies (including documentaries);
43. Variety shows;
54. Children’s programs.
6If the licensed operation plan has specified that the channel provides foreign programs as its primary operational objective, the supplier of the said channel shall not be restricted by the preceding paragraph.
7The designated broadcasting times for the programs listed in items 1 and 3 of Paragraph 1 shall be from 8PM to 10PM each evening; the designated broadcasting time slots for the programs listed in item 2 shall be from 9PM to 11PM each evening; the designated broadcasting time slots for the programs listed in item 4 shall be from 5PM to 7PM each evening.

1The types of programs broadcast during designated time slots as listed in Paragraph 1 of the preceding Article are hereby defined as follows:
21. Dramas: narrative programs that combine characters, plot, and setting. These programs may be broadcast in the forms of television series, anthology series, mini-series, or television films.
32. Movies (including documentaries): domestically-produced movies, foreign-produced movies, and television movies broadcast in the form of television programs.
43. Variety shows: music programs (including musical talent shows), singing/dancing programs (including singing/dancing talent shows), talent shows, short plays, game shows, competition-based reality shows, travel shows, food shows, or other programs that incorporate elements of culture, art, or entertainment, or those that present topics on everyday life in the aforementioned manner.
54. Children’s programs: programs produced for an audience of children 12 years old and younger.
During the calculation period aforementioned in the preceding article, program suppliers shall report the actual broadcasting situations to the competent authority periodically.
1These Regulations shall be effective from January 8, 2017.
2The revised articles of these Regulations shall be effective from January 1, 2020.
8For sports programs, should the presenters or commentators be nationals of the Republic of China, they shall be deemed as domestically-produced programs and shall not be restricted by the identification standards aforementioned in preceding paragraphs.
9For music video programs, should the presenters or commentators be nationals of the Republic of China and the program falls under any one of the following circumstances, they will be deemed as domestically-produced program:
101.Nationals of the Republic of China sing the main music or lyrics.
112.Nationals of the Republic of China participate in the arrangement of the music.
123.Nationals of the Republic of China participate as lyricists.
134.A live concert recorded within the territory of the Republic of China.
9When a program is co-produced by more than one supplier that has invested more than thirty percent capital, the program broadcast for the first time over the suppliers’ own channel shall be deemed as a new broadcast.
10The percentages specified in Paragraph 1 shall be calculated according to the annual broadcasting hours of each channel.
11The percentage restriction in Paragraph 1 may be adjusted by the competent authority according to the circumstances of domestically-produced programs, audience demand or other circumstances.
